AB 827 requires certain businesses to provide customers with recycling and organics (food waste) collection bins adjacent to all trash bins, to collect products purchased and consumed by customers on the premises.
The law is effective on July 1, 2020.

Businesses subject to Mandatory Commercial Recycling and Mandatory Commercial Organics Recycling.
Are there any exemptions?
Full-service restaurants are exempt and do not have to provide properly labeled bins for customers but must provide properly labeled recycling and organic waste bins next to trash bins for employees to separate recyclables and organics for customers.
Are there exemptions due to COVID-19?
If businesses are not allowed to have customers consume products onsite due to COVID-19, then the businesses do not currently need to have the appropriate bins and signage for their customers to use. When customers are allowed to consume products onsite again, then businesses will need to have the bins and signage.
What are the requirements for this law?
- Recycling and organic waste bins must be visible and easily accessible to customers.
- Bins must be clearly marked with labeling indicating which materials are appropriate for each bin. CalRecycle has signage for businesses to use or you can use your own. CalRecycle signage can be accessed here.
- Bins must be placed adjacent to each trash can (restroom waste bins are excluded). There is no minimum number of bins required.
What if a business sells food but does not offer immediate consumption?
If all material is taken and consumed off-site and there is no trash container for customers to use, then containers for organic waste are not required.
Who is responsible for providing bins?
The business is responsible for providing bins. Currently, no funding is available from CalRecycle for implementing this law.
